Bajaj said that move is meant to protect the record. If a jury convicted her of murder with no lesser-included offense on the verdict form, he said, it would be almost a guaranteed ground for reversal on appeal. Giving the jury manslaughter also opens the door to a compromise verdict. The Meta settlement is a different problem. Bajaj said a payout that large is a calculated move to cut losses short. On the agreed screen-time limits for children, his line was that this is not the job of a court. That is the job of the parent. Bajaj explained that under the Massachusetts Model Penal Code, the Commonwealth must prove beyond a reasonable doubt that a mental disorder did not erase knowing right from wrong. His line: that standard is "so friendly to the defendant… that it forces the prosecutor to prove a negative." Three verdicts: guilty, not guilty, or not criminally responsible. A full acquittal is unlikely, he said, because "she admitted to the crime, she did the crime." Not criminally responsible still means "decades, at least a decade and a half" in a mental-health facility. He declined to predict the jury.
