Repeat DUI penalties
If you have been convicted of drunk driving in the past 10 years, subsequent DUI penalties are as follows:
- 2nd DUI – License suspension for two years, up to one year in jail, fines between $1,800 and $2,800
- 3rd DUI – License suspension for three years, up to one year in jail, fines between $1,800 and $2,800
- 4th DUI – License suspension for up to four years, up to three years in jail
In addition to these penalties, a repeat DUI offender may be required to attend DUI school, do community service, and suffer other penalties at the judge’s discretion.
Minimizing the impact of a multiple DUI conviction
Whenever possible, we help clients charged with a second, third, or fourth DUI avoid conviction. We know how to challenge the validity of the traffic stop, breathalyzer and blood alcohol tests (BAC), and other aspects of your DUI arrest.
If you are convicted of a repeat DUI, we will work hard to minimize the penalties you face. Depending on the circumstances of your case, we will make recommendations alternative to jail time. This could include increased community service or other arrangements with the court based on the specific factors in your case.
